training NEDISCRIMINAREA. ASPECTE JURIDICE INTERNAȚIONALE ȘI NAȚIONALE (rom. eng.)

La 30 septembrie, curent, Centrul de Drept al Avocaţilor, organizaţie nonguvernamentală, (partener de implementare a proiectelor Reprezentanţei Înaltului Comisariat al ONU pentru Refugiaţi în Moldova (UNHCR), în colaborare cu Consiliul Uniunii Avocaților din Repubica Moldova, a organizat training-ul cu tema: NEDISCRIMINAREA. ASPECTE JURIDICE INTERNAŢIONALE ŞI NAŢIONALE. JURISPRUDENŢA CEDO ŞI JURISPRUDENŢA NAŢIONALĂ ÎN DOMENIU. 

Desfăşurat în incinta Judecătoriei Sectorului Botanica, training-ul a fost destinat  în specal avocaţilor cu experienţă mai mare de cinci ani, fiind deschis pentru toţi cei interesaţi de diversele aspecte ale principiului NEDISCRIMINĂRII - contextul jurisprudenţei naţionale şi internaţionale - studenţi, judecători, procurori, poliţişti etc. Scopul proiectului este creșterea nivelului de cunoștințe ale avocaților și sensibilizarea opiniei publice privind combaterea discriminării în Moldova. În discursul de inaugurare şi de prezentare a proiectului "Creșterea Înivelului de cunoștințe ale avocaților și sensibilizarea opiniei publice privind combaterea discriminării în Moldova’’ dl Alexei BARBĂNEAGRĂ,   avocat, prof. univ., Director alCentrului de Drept al Avocaţilor, a menţionat că tema abordată în cadrul training-ului este una de o stringentă actualitate, iar invitaţii, practic, vor asista pentru prima dată, în Moldova, la o asemenea întrunire în cadrul căreia va fi pusă în discuţie problema nediscriminării nu doar din perspectiva teoretică, ci şi practică, cu examinarea unor procese/cauze concrete din activitatea juriştilor noştri prezentate la diferit nivel şi în diferite instanţe. 

În cadrul training-ului, în calitate de experţi au fost invitaţi şi au prezentat comunicate binecunoscuţii şi apreciaţii experţi: dl Gheorghe AMIHALACHIOAIE, Preşedintele Uniunii Avocaţilor din Republica Moldova, - comunicatul Legislația internaţională şi naţională cu privire la nediscriminare; dna Janeta Hanganu, avocată, BAA „Hanganu, Tănase şi partenerii” - Unele aspecte ale jurisprudenţei CEDO în materie de nediscriminare; dna Doina Ioana Străisteanu, avocată, BAA „Panţîru şi Străisteanu” - Jurisprudența națională în domeniul nediscriminării.

Problema nediscriminării a fost prezentată din perspectiva mai multor forme. Despre cea mai gravă formă a discriminării, calificată de către Comisia Europeană împotriva Rasismului şi Intoleranţei, discriminarea rasială, a vorbit dna Hanganu, care, între altele, a menţionat că aparteidul este cea mai gravă problemă a discriminării, de aceea, statul trebuie să adopte măsuri pentru a corecta inegalităţi faptice dintre diferite grupuri. Mai mult, în lipsa unor măsuri de corectare a inegalităţii date prin implementarea unor măsuri de tratament diferenţiat, poate, în lipsa unor justificări obiective şi rezonabile, să fie considerată drept incompatibilă cu Articolul 14 al Convenţiei Europene pentru Drepturile Omului.

Auditoriul a fost informat privind gravele probleme ale descriminării: diferenţa de tratament, domeniile speciale de discriminare, aici au fost specificate: SEXUL, RASA, ETNIA si RELIGIA, cauze moldovenesti ce au ridicat aspecte legale de discriminare. Problemele au fost abordate de dna Hanganu atît din perspectiva teoretică  cît şi din cea practică, fiind exemplificate cu cazuri reale asupra cărora a lucrat sau lucrează în prezent.

Jurisprudenţa naţională în domeniu nedescriminării a fost prezentată de dna Doina Ioana Străisteanu, avocată la BAA “Panţîru si Străisteanu”, expertă în Drepturile Omului. Dna Străisteanu, pe lîngă ampla prezentare a temei, a prezentat şi un caz concret, care vizează drepturile persoanelor ce aparţin minorităţilor naţionale şi statutul juridic al organizaţiilor lor, asupra căruia lucrează, care a trezit interes colegilor de breasla prezenţi în sală, constituind temeiul unui dialog productiv între experti si avocaţii prezenţi prezenţi.

Training-ul face parte din numărul celor 40 de ore de perfecţionare anuale, obligatorii pentru fiecare specialist în domeniul dreptului; iar în sală au fost prezenţi peste 50 de persoane interesate de problema nedescriminării, care s-au confruntat, sau se confrunta în present cu cazuri de discriminare.

În final participanţii şi-au exprimat mulţumirea si plăcerea pentru invitaţia la training, pentru că aceasta le-a creat posibilitatea de a-şi împărtăşi experienţa cu colegii din domeniu şi să asculte părerea experţilor asupra unor cazuri reale.

Training-ul a fost spijinul financiar de  Programul Naţiunilor Unite pentru Dezvoltare (PNUD) în cadrul proiectului "Creșterea nivelului de cunoștințe ale avocaților și sensibilizarea opiniei publice privind combaterea discriminării în Moldova’’.

Training Non-discrimination - international and national legal aspects

On 30 September, this year, the Law Center of Advocates, non-governmental organization, (project implementing partner of United Nations High Commissioner for Refugees (UNHCR), in collaboration with the Council of the Lawyers Association in Republic of Moldova, organized the training with the theme: Non-discrimination-international and national legal aspects. ECHR jurisprudence and national jurisprudence in this field.

It took place in the Court of Botanica Sector; the training was intended in special for lawyers with more than five years experience, being opened for all those interested in various aspects of the principle of NON-DISCRIMINATION – national and international case law context- students, judges, prosecutors, police etc.  The project aim is to increase the level of knowledge of lawyers and public awareness on combating discrimination in Moldova. In the speech of inauguration and presentation of the project ‘Increasing the knowledge level of lawyers and public awareness on combating discrimination in Moldova’ Mr. Alexei Barbaneagra, lawyer, university professor, Director of the Law Center of Advocates, said that the issue debated in the training is a urgent actuality, and invitees, practically will assist for the first time, in Moldova at such meeting in which will be discussed the issue of non-discrimination not only theoretical. But also practical, with the evaluation of some process/ causes from the activity of our lawyers presented at different levels and different courts.

During the training, as experts were invited and had communicated well known and appreciated experts: - Gheorghe AMIHALACHIOAIE, President of the Lawyers Association in Moldova, - International and national law on non-discrimination; Mrs. Janeta Hanganu, lawyer, BAA „Hanganu, Tănase şi partenerii” – Some aspects of the ECHR law on non-discriminations; Mrs. Doina Ioana Străisteanu, lawyer, BAA „Panţîru şi Străisteanu’’ – National law in the non-discrimination field.

Non-discrimination problem was presented from the perspective of different forms. About the most serious form of discrimination, qualified by the European Commission against Racism and Intolerance, racial discrimination, spoke Ms. Hanganu, which mentioned also that apartheid is the most serious problem of discrimination, therefore, the state must adopt measures to correct factual inequalities between different groups. Moreover, in the absence of corrective measures of the inequalities by implementation of some measures of differential treatment, may be in the absence of objective justifications cam be seen as incompatible with the Article 14 of the European Convention on Human Rights

The audience was informed about serious problems of discrimination: differential treatment, special fields of discrimination, here was mentioned: GENDER, RACE, ETHNICITY and RELIGION, Moldavian causes which raised legal aspects of discrimination. The problems were addressed by Ms. Hanganu both theoretical and practical, being exemplified with real cases.

National jurisprudence the field of non-discrimination was presented by Mrs. Doina Ioana Străisteanu, lawyer, BAA „Panţîru şi Străisteanu’’, expert in Human Rights. Mrs. Străisteanu, beside extensive presentation of the theme, also presents a real case, which concerns the rights of persons belonging to national minorities and legal status of their organizations, on which she works, the case raised the interest of colleagues.

The training is a part of the number of 40 hours of annual training mandatory for every specialist in law; the training was attended by 50 people interested in non-discrimination issue, which have faced or face in present with cases of discrimination. 

At the end participants expressed their satisfaction and pleasure for the invitation, because it has created the opportunity to share experience with colleagues in the field and to listen experts opinion on real cases.

UNHCR SPRIJINĂ UNIVERSITĂŢILE DIN MOLDOVA (III) (rom. eng.)

Pe data de 28 septembrie, curent, în incinta Universităţii Libere Internaţionale din Moldova (ULIM), a avut loc ceremonia oficială de transmitere a nouă seturi de calculatoare de către Reprezentanţa Înaltului Comisariat al Organizaţiei Natiunilor Unite pentru Refugiati în Moldova (UNHCR) care vor fi utilizate de către studenţii de aici.

Donaţia computerilor, în valoare de 64 de mii de lei, constituie o componentă a proiectului Integrarea Locală a refugiaţilor în Belarus, Moldova şi Ucraina, finanţat de Uniunea Europeană şi co-finanţat şi implementat de Reprezentanţa UNHCR în Moldova. 

Activităţile proiectului de integrare locală pentru refugiaţi şi beneficiarii de protecţie umanitară constau în oferirea de asistenţă socială şi medicală, oportunităţi de formare profesională şi ocuparea forţei de muncă, cursuri de limbă română şi cazare. Tehnica respectivă urmează să fie utilizată de către studenţii de aici, în cadrul cursurilor universitare, inclusiv de către studenţii străini, care îşi fac studiile la ULIM, în vederea studierii limbii române. 

Întîlnirea a fost deschisă de dl Gehard Ohrband, reprezentantul Centrului de cooperare Internaţională ULIM, care a mulţumit Reprezentanţei UNHCR pentru gestul cu adevărat preţios, amintind şi de o altă activitate realizată cu sprijnul acestei Agenţii ONU şi anume organizarea cursurilor de studiere a limbii române de către un grup de refugiaţi şi amenajarea unui auditoriu cu utilaje moderne.

În luarea sa de cuvînt, dl Peter Kessler, Reprezentantul UNHCR în Moldova, a reiterat disponibilitatea UNHCR de a continua şi a amplifica relaţiile de colaborare cu ULIM, astfel ca studenţii să-şi poată face studiile în condiţii cît se poate de bune.

Totodată, Kessler a amintit de situaţia defavorabilă în care se află zeci de mii de refugiaţi, inclusiv tineri refugiaţi, din întreaga lume şi de necesitatea sprijinirii acestei categorii de persoane, inclusiv a celora care se află în R.Moldova. În acest sens, UNHCR şi partenerii săi internaţinali sprijină nu doar refugiaţii şi solicitanţii de azil, ci şi o serie de instituţii guvernamentale prin diverse donaţii de: cărti de specialitate, mai ales din domeniul drepturilor omului şi dreptului umanitar; tehnică computativă, automobile, de care a beneficiat deja Serviciul Grăniceri, Instituţiile de Drept şi de învăţămînt din mai multe raioane; şi activităţi: cursuri de dreptul refugiaţilor, mass-media şi refugiaţii, lecţii publice etc. – a menţionat dl Kessler.  

Dna Ludmila Hometkovski, Decanul Facultăţii Limbi Străine şi Ştiinte ale Comunicării, a menţionat: faptul că reprezentanţii UNHCR ne-au trecut pragul şi la acest început de an de studii, e o dovadă în plus că este un partener sigur şi chiar un prieten care merită aprecierile noastre cele mai sincere. Nu este pentru prima oară cînd UNHCR donează echipament şi mobilier universităţii noastre. Cele nouă calculatoare în foarte scurt timp vor fi puse la dispoziţia studenţilor şi cu siguranţă vor fi utilizate şi pentru desfăşurarea cursului de Limba Română pentru studenţii străini.

UNHCR SUPPORTS UNIVERSITIES IN MOLDOVA (III)

On 28 September, this year, inside the Free International University of Moldova (ULIM), took place the official ceremony of transmission of nine sets of computers by the Representation of United Nations High Commissioner for Refugees (UNHCR), to be used by students.

The donated computers worth 64.000 lei and are component of the project Local Integration of Refugees in Belarus, Moldova and Ukraine, funded by the European Union and co-financed and implemented in Moldova by UNHCR Representation in Moldova.

Project activities of local integration for refugees and beneficiaries of humanitarian protection consists of providing social and medical assistance, opportunities of professional development and employment, Romanian language courses and accommodation. That technique follows to be used by the students, in the university courses, including foreign students studying at ULIM, to study Romanian language.

The meeting was opened by Mr. Gehard Ohrband, representative of the International Cooperation Center ULIM, who thanked the UNHCR Representation for a truly valuable gesture, he also reminded about another undertaken activity with the support of the UN Agency, namely the organization of courses of study Romanian language by a group of refugees and arranging an auditorium with modern equipment.

In his speech, Mr. Peter Kessler, UNHCR Representative in Moldova, reiterated UNHCR availability to continue and enhance cooperation relations with ULIM, so that students could be able to study in as good conditions as possible.

However, Kessler pointed out the unfavorable situations in which are tens of thousands of refugees, including young refugees around the world and the need to support this category of people, including those who are in Moldova. In this regard, UNHCR and its international partners support not just the refugees and asylum seekers, but also a number of governmental institutions through different donations of: specialty books, especially in the field of human rights and humanitarian law; computers, cars, of which already beneficiated Border Guard Service, Law and Educational Institutions in several districts; and activities: course about the refugee rights, mass-media and refugees, public lectures etc. – Mr. Kessler said.

Ms. Ludmila Hometkovski, Dean of the Faculty of Foreign Languages and Communication Sciences, said: the fact that UNHCR Representatives visit us at the beginning of this new academic year is a proof that it is a reliable partner and even a friend who deserves our most honest appreciation. It is not for the first time when UNHCR donates equipment and furniture to our university. The nine computers in short time will be made available for students and certainly will be used for the course of Romanian language for foreign students. 

The ceremony was attended by Mr. Dumitru Lipcanu, Programs/Finances Administrator UNHCR in Moldova, Svetlana Jioară, Programs Associate, UNHCR Moldova; representatives of ULIM administration and of non-governmental organizations in asylum field and a group of students from the Journalism and Foreign Languages Department.

NGOs Fair in Chişinău - second edition

In Chişinău today was held the second edition of the ‚’’NGOs Fair’’. Under the title ‚’’Meet the NGO that represents you!’’, the event has as goal informing the society about the activities and services of nongovernmental organizations. The Fair was attended by about 35 NGOs, which in addition to their duties presented various publications, brochures, leaflets to those present.   

   Development and promoting of folk crafts is the strength point of the NGO Community Association Artizana. Constantin Olteanu, coordinator of the Association spoke about a special field of art to those interested. ‘Our occupation is the development and promoting the folk crafts in the south of the country. We work with children from the Boarding School, with children from the community and even with unemployed. Who wants to get a job, an occupation, it is welcome in our Center.’’

Family values, conservative values have been promoted within the Fair by the NGO ‘Family Association’. Formed after the challenges of the gay parades in 2008, members of the NGO, along with Vitalie Marian, vice president of the association, presented a set of books including: ‘What the Bible says about the sexuality’.’’We promote family values, according to the name of the association – ‘Family Association’ – values from the perspective of the Saint Scripture, the conservative and healthy values. We go to schools with the book exposed here – ‘What the Bible says about the sexuality’. It is a book with 5 lessons, each 40 minutes in which we explain to children what the Bible says about relations before marriage, within the marriage, about adultery, about abortion, which are, in fact, sensitive issues’.

Organizing such events it’s a good thing for visitors. Angela from the State University of Moldova remained satisfied by the event itself as well as for her personal involvement in some NGOs. ‘‘I am very glad that I can be at the Fair. There are some organizations trying to mobilize us, because our society doesn’t have civic education. I have worked in some nongovernmental organizations presented here – I participated at trainings, seminars, a series of very important lessons.’’

As a result of the first edition in April, this year, NGOs have managed to recruit volunteers and to collect funds for their activities. Citizens have pursued various interactive activities, workshops, demonstrations and even got involved into their realization with NCOs members.

‘’The Moldovan tale of an Indian girl’’

Khan Alvinais is an 11 year old girl who is studying in 5^th grade in one of the lyceums from Chişinău. She is the fruit of love between her father of Indian origin and her mother a Moldovan citizen. Born and raised in Moldova she didn’t have the chance to see her grandparents, uncles and cousins living in India. I’ve met with Alvina at the ethnic Festival with the title Unity through Diversity Along with refugees representatives in Moldova, the girl dressed in traditional Indian clothing was promoting the traditions found in Indian movies and in her father tales.

You are born in Moldova and you have never seen your father’s country, how are you feeling in Republic of Moldova? How are you treated by your colleagues?

I feel like home, because I always lived in Moldova and I never visited my father’s country, although I would like to visit it very much. I’m glad that I have my parents near, but I would like to meet my relatives in India, which so far I have seen only on pictures. 

Colleagues treat me with great esteem. I was never discriminated, as it is said about refugees. In my case, things are different; even more I have many Moldavian friends. However, I wish I could have a friend to share the same love for Indian traditions, which I ‘m personally in love.

As proof is your clothing. In addition to the promoting of Indian traditions along with your parents through the exhibition of typical traditional works. What are you doing today?

I will attend today’s concert, dancing on the rhythm of an Indian song. I dance since I was a child, I like it very much and I will never stop dancing. And this Festival it is a chance to promote Indian traditions.

Your mother is a Moldovan citizen, did you tried to dance Moldavian traditional dances?

I feel better on the rhythm of Indian dances, but Moldovan traditions are also beautiful. All we keep our traditions and even if we live in other countries we should promote our traditions there.

Being in Moldova, from who you learned to dance on Indian music?  

I learned it by myself, following since I was a child Indian movies, but also from my father who never gave up on his traditions, even if he lives for many years in Moldova. My family keeps these traditions, not just once a year as this event, but every day. My mother loves very much my father, that’s why she accepted his traditions, even if she never gave up on her Moldovan traditions. I’m so glad that despite cultural differences, my parents are very happy together .One of the reasons that I love in living in Moldova is that Moldovan people treat us with respect, that’s why I love speaking Romanian language and studying here.

What do you want or what do you miss here in Moldova?

I would like very much to meet my family from India. I would like to visit them or even to live with them. I also would like more Indian friends with whom I could dance on Indian music.

Târgul ONG-urilor la Chişinău - ediţia a doua

  

La Chişinău astăzi s-a desfăşurat cea de-a doua ediţie a “Târgului ONG-urilor”. Sub genericul “Cunoaşte ONG-ul care te reprezintă!”, evenimentul a avut ca scop informarea societăţii despre activitatea şi serviciile organizaţiilor nonguvernamentale. La târg au participat aproximativ 35 de ONG-uri, care, în afară de sarcinile lor statutare, au mai prezentat şi diversele publicații, broșuri, pliante celor prezenţi.

Dezvoltarea şi promovarea meşteşugăritului popular, este punctul forte a ONG-lui Asociaţia Obştească Artizana.  Constantin Olteanu, coordonatorul asociaţiei a vorbit trecătorilor şi celor interesaţi despre un domeniu de artă mai deosebi. ,,Ocupaţia noastră este dezvoltarea şi promovarea meşteşugăritului popular în regiunea de sud a republicii. Lucrăm cu copiii de la Şcoala Internat, cu copiii din comunitate şi chiar cu şomerii. Cine doreşte să capete o meserie, o ocupaţie, este binevenit la Centrul nostru”.

Valorile familiei, valori conservatoare au fost promovate în cadrul Târgului de către ONG-ul, ,,Asociaţia pentru Familie’’. Formată în urma provocărilor paradelor homosexualilor din 2008, membrii ONG-ului, împreună cu Vitalie Marian, vicepreşedintele asociaţiei au prezentat şi un set de cărţi printre care: „Ce spune Biblia despre sexualitate”. ,,Promovăm valorile familiei, conform denumirii asociaţiei –  „Asociaţia pentru Familie” – valorile din perspectiva Sfintei Scripturi, adică valori conservătoare şi sănătoase. Mergem prin şcoli cu manualul pe care l-am expus aici -– „Ce spune Biblia despre sexualitate”. Este un manual cu 5 lecţii a câte 40 de minute în care explicăm copiilor ce spune Biblia despre relaţiile de până la căsătorie, în cadrul căsătoriei, despre adulter, despre avort,  care sunt, la drpt vorbind, subiecte sensibile”.

Organizarea unor astfel de evenimente au bucurat şi ochii vizitatorilor. Angela, de la Universitatea de Stat din Moldova, a rămas mulţumită atât de evenimentul propriu-zis, cât şi de implicarea ei personală în cadrul unor ONG-uri. ,,Mă bucur foarte mult că am posibilitatea să fiu la acest Târg. Sunt nişte organizaţii care încearcă să ne mobilizeze, pentru că societatea noastră nu prea are o educaţie civică. Eu am activat în cadrul unor organizaţii non-guvernamentale prezente şi aici – am participat la training-uri, seminare, la o serie de lecţii foarte importante”.

În rezultatul primei ediţii din aprilie, curent, ONG-urile au reuşit să recruteze voluntari şi să colecteze fonduri pentru activitatea lor. Cetăţenii au urmărit diverse activităţi interactive, ateliere, demonstraţii, şi chiar s-au implicat în realizarea acestora împreună cu unii ONG-işti.

Refugees at the Ethnic Festival

Every year, refugees and asylum seekers in Moldova are present at the Ethnic Festival organized in Chisinau. In this year edition, the team of the Charity Center for Refugees attracted the attention through oriental music, which woke up a great interest among visitors.  They have shown interest in the objects from clay, and especially in the traditional food prepared by a group of refugee women in Moldova.

Mr. Djavid Pahnehad, project coordinator of the Charity Center for Refugees, present at the Festival, said:  We are glad that Moldovans are much more receptive to the refugees’ problems and that they became friendlier with them. We are honored with the presence not just of the locals and guest of the capital, but also of the dignitaries of this country. Although it is still morning, people do not hesitate to come and enjoy the beautiful traditions characteristic to different ethnic. 

Demonstrating to visitors the music and the traditional dances, Djavid, reveals that the purpose of the Festival is not only to present some nuances of traditions, but to encourage the spirit of tolerance and intercultural dialogue, inter-ethnic. We want to show to the public our traditions and customs, and to strengthen friendly relations between representatives of different nationalities, which are living on the Moldovan territory. 

Referring to the refugees’ situation in republic of Moldova, Mr. Paknehad told us that among the major problems faced by beneficiaries of the UN High Commissioner for Refugees, is the lack of jobs and housing:  It is difficult and expensive to live in Chisinau. Needs for a decent living are high, and refugees, as other locals are unable to face this situation. In addition to the lack of employing, we need food and clothing, which also require expenses.

Ştefan cel Mare şi Sfânt Central Park hosted again the national culture, customs and traditions of Moldovans and Ukrainians, Russians and Belarusians, Gagauzians and Bulgarians, Gypsies and Jews, Poles, Lithuanians, Estonians, Armenians and many other ethnic groups living in Moldova.  

The Ethnic Festival themed Unity through diversity, which is held annually, in the third Sunday of September, it is supported and organized by the Bureau of Inter-ethnic Relations (BIR) together with the Ministry of Culture, local public authorities, mayoralties of Chisinau and Balti, Executive Committee of Gagauzia , ethno-cultural organizations in the country.

This year, the event itself was in the eleventh edition and was in the program of actions dedicated to the 20^th anniversary of Independence of Republic of Moldova and from the founding of the Bureau of Inter-ethnic Relations
